社運至今接近4年，香港經歷緊社運前所未有嘅後社運低潮，亦係可視嘅將來都唔會再出現好似2019年咁大規模嘅社運，但係我懇請大家唔好忘記仲有一班為我哋付出過嘅手足。係嚟段時間入面，到底有幾多手足正身陷囹圄，又或者係正等待被不公義嘅法庭審判？
被控暴動、罪成人數
截至 2022 年 12 月 21 日，參考《法庭線》按法庭紀錄及報道統計被控暴動人數及罪成人數為：
819 人被控暴動，至今約四成案件審結。
今年內，再有 37 人（39 人次）被起訴或加控。
今年內，共有 208 人（209 人次）的暴動案審結，9 人罪名不成立，其餘 199 人（200 人次）罪成。
最重判刑
5年半，屬2022年暴動案中最重判刑。
案件為兩名男生被指在上水向七旬清潔工掟磚，在高院審結，陪審團裁定誤殺罪不成立、暴動罪成。
刑期及出獄時間
根據法庭線的「理大衝突3年分析」，41名暴動罪成、被判監的被告當中，有10人被判3年以下；17人被判3年至3年11個月；11人被判 4年至4 年11個月；3人被判5年或以上。《法庭線》計算他們刑滿及預計出獄日期，假設被告獄中行為良好、一般可獲扣減三分一刑期，有4人將於今年出獄。21名被告料於2024年出獄，佔整體逾一半；其餘15人料於2025年出獄。
放學手足嘅去向係我哋要思考嘅問題，多數被控暴動嘅手足出獄後都因為有案底而令佢哋係有限嘅空間下發揮佢哋嘅所有，因此有啲手足希望可以係另一個地方生活。所以我哋相信，而家我哋可以幫手足搵定佢哋放學後嘅出路，減輕佢哋出獄後重投社會嘅壓力。我哋會陪伴所有在囚或曾在囚嘅手足，直至佢安頓好以後嘅生活。

The Future of the Jailed Hong Kongers (Part 1)
It has been nearly 4 years since the 2019 Anti-Extradition Law Amendment Bill social movement, and now we are at such a low ebb that we will never experience a large-scale social movement in Hong Kong in the foreseeable future. In the meantime, we should never forget every comrade, especially those who are either in jail or waiting for an unjust judgement.
The number of people charged and the number of people who are convicted of rioting
The numbers are in accordance with The Witness’s research on court records and news reports. The numbers are as of December 21, 2022.
819 people were charged with rioting, and around 40% of the cases have been concluded so far. In 2022, 37 more people were indicted or charged. Moreover, in 2022, a total of 209 riot cases were concluded, 9 people were not convicted, and the remaining 199 people were convicted.
The Heaviest Penalty for Rioting
5.5 years, which is also the heaviest penalty among all the rioting cases in 2022.
It was the case where two Hong Kong teens were cleared of murdering the 70-year-old cleaner but were arbitrated for rioting.
Sentence and release time
According to The Witness’s post regarding the 3rd anniversary of the Poly U incident, 41 people were found guilty. 10 of them received sentences of less than 3 years. 17 people were sentenced to prison terms ranging from 3 years to 3 years and 11 months. 11 defendants received sentences of 4 years to 4 years and 11 months, and 3 received sentences of more than 5 years. The Witness predicted and suggested that the accused's sentence would be reduced by one-third if he behaved well in prison. Therefore, apart from Lin, who was released in July 2022, four accused will be released this year. 21 will be released in 2024, which is half of the rioting cases. The remaining 15 will be released in 2025.
We need to think of our imprisoned comrades or those who have been imprisoned. After being charged with rioting and imprisonment, they may face hardship if they would like to continue their lives in Hong Kong. Therefore, we believe that searching for living alternatives is something we can do, especially for comrades who would like to live on in a new place. We promise to do our best to assist and provide alternatives to imprisoned comrades or those who have been imprisoned until they have settled for a new life.
